Terms of engagement
These terms apply when you ask CloudKernel Path Advisory to read an application pack. They are written for professional file-review work, not for a software subscription or a shop.

1. What we agree to do
We provide a financial reading of documents you supply in connection with an application to a payment gateway platform. The scope is the engagement you book — application file review, settlement reading, chargeback and reserve assessment, or a pre-submission readiness memo — as described on this site and confirmed in our written quote.
We do not process payments, open gateway accounts, or act as your agent with a platform unless a separate written instruction says so. Nothing on this site is an offer to underwrite, insure, or guarantee acceptance by any gateway.
2. Your papers
You warrant that you are authorised to send us the statements, reports, and ownership papers you provide, and that they belong to the trading entity named in the engagement. You remain responsible for the completeness of the pack and for any submission you later make to a gateway.
Do not send original identity documents by unsecured means. We will tell you how to transmit statements after the inventory call.
3. Quotes, deposits, and fees
Fees are quoted after an inventory call. A quote is valid for 14 days unless it says otherwise. Work starts when we have received the agreed deposit and a pack that matches the inventory we accepted. Time estimates in working days begin on that date, not on the date of first enquiry.

4. Findings are not approvals
A findings memo is our reading of the papers you gave us, dated, for your internal use. It is not a letter of support, not an audit opinion under the Companies Act 2016, and not advice to any payment gateway. A gateway may still decline, request more papers, or apply reserves we did not predict.
5. Confidentiality
We keep application packs confidential and use them only to perform the engagement and to keep records we are required to keep. We do not sell your file. We may refuse or end an engagement if papers appear forged, or if we are asked to write a figure we cannot tie to an exhibit.
6. Liability
We are not liable for a gateway’s decision, for loss of processing, or for delay caused by papers you did not supply. Our aggregate liability for an engagement is limited to the fees you paid for that engagement, except where Malaysian law does not allow that limit (including death or personal injury caused by negligence, or fraud).
7. Site use
This website is informational. It does not create an engagement until we accept a quote in writing. You may not scrape, republish, or present our memos as a gateway’s own underwriting.
8. Law
These terms are governed by the laws of Malaysia. The courts of Sarawak have exclusive jurisdiction, except that we may seek urgent relief elsewhere to protect confidential papers.
9. Changes
If we change these terms, the version in force is the one linked from the quote you accepted. Continued use of the public site after a change applies to new enquiries only.
